If you book a service with us, then we rely on your representation that you will fulfill your end of the arrangement and we will of ours. All sales are final and therefore once offer and acceptance have been confirmed, you will be bound to the terms. This is due to our busy schedule.
You are responsible to pay for the Spell Casts Services in full (including all applicable sales and other taxes or fees) and for providing us with a valid credit card or other payment method. If you have selected a payment plan and you miss a payment, your account status will be changed to “delinquent.” You will immediately lose access to future Services and Bonuses until all payments are made in full.
If your account remains in delinquent status for longer than sixty (60) days, the Company reserves the right to report any delinquent balance owed to a credit reporting bureau and/or collections agency subject to the Company’s sole discretion until the account is caught up and in good standing.
To be clear, Spell Casts is not a “pay in part” Service where you can pay only for access to certain Services and not others. Services must be paid in full and your payment plan is a convenience that we offer so that you can make the price sustainable.
Service Requested is Not Time Sensitive. You understand and acknowledge that the service you have requested is not urgent and that time is not of the essence. If, however, your inquiry is urgent or time-sensitive, then separate, additional, written arrangements need to be made with Spell Casts. If no such documented, written arrangements are made on timing of delivery, then you hereby assure us that your request and needs are not time-sensitive.
Refund Policy for Services. You are requesting a service tendered from experience, specialised knowledge, and personalised attention. Thus, all purchases are non-refundable. You cannot cancel an order if its status shows “Order Processed”. “Order Processed” means that the recipient has already reviewed your order information and booked your service. Please be certain about your purchase before you book. All service fulfillments are final. Nonetheless, we at Spell Casts want to ensure that you glean the most value from your experience with us, and so if you have any questions or concerns, please do not hesitate to reach out. We would be more than happy to attend to you and see what we can do to resolve any concerns you may have.
If the payment you’ve sent shows “Unclaimed” or “Pending,” it means that the recipient hasn’t received or accepted it. You’ll be able to cancel your payment if a “Cancel” button shows up beside it on the Activity page. Or you can also ask the recipient to refuse the payment.
If a payment remains unclaimed for 30 days, it’ll be canceled automatically and refunded to you.
In the unlikely event that you did not authorise the purchase, we’ll help you resolve it and get your money back.
When you have any concern with your purchase, we recommend that you always contact your consultant directly first. This is often the faster and easier way to clear a misunderstanding and resolve a small issue.
Chargebacks. Spell Casts will not continue to provide service to customers who file chargebacks. All documentation and email correspondence if applicable will be handed over to our merchant to support proof that you have received the Service and authorised any charges from us. We do not tolerate chargeback fraud, and all fraud, without exception, will be prosecuted through criminal proceedings in your local jurisdiction to the fullest extent of the law. In addition, we will pursue civil legal action in your local jurisdiction seeking any loss of income related to the fraud, including business, legal fees, research costs, employee down time and loss of revenues.
Entertainment Purposes Only. The services provided by Spell Casts are for entertainment purposes only. Services provided by Spell Casts in no way replace professional counseling from a licensed counselor or therapist and cannot be relied upon in lieu of sound legal, medical, or financial advice from licensed or qualified professionals.
Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Spell Casts customer, employee, member, or officer will result in immediate service termination.
Intellectual Property. You agree that Spell Casts’ Service contains proprietary Content that is owned by the Company and/or its licensors and is protected by copyright, trademark and other applicable intellectual property laws. Duplicating, sharing or uploading Spell Casts Content to sharing sites is considered stealing, and the Company will prosecute such misconduct to the fullest extent permitted by law.
The Company provides you with Spell Casts Content solely for your personal, noncommercial use, and you agree that you will not use such proprietary Content in any way whatsoever except for use in compliance with this Agreement. You will not use Spell Casts Content or the Content available in the Product in a manner that constitutes an infringement of the Company’s rights or that has not been authorised in writing by the Company. More specifically, unless explicitly authorised in this Agreement, you may not modify, copy, reproduce, republish, upload, post, transmit, rent, lease, loan, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any material from Spell Casts Content. You may, however, from time to time, download and/or print one copy of individual pages of the Site for your personal, noncommercial use, provided that you keep intact all copyright, trademark, and other proprietary notices.
By purchasing access to our Services, you agree:
- not to infringe any copyright, patent, trademark, trade secret or other intellectual property rights of the Company and its liaisons;
- that any confidential information shared by Spell Casts liaisons or any of the Company’s representatives is confidential and proprietary and belongs solely and exclusively to the liaison who discloses it or to the Company;
- not to disclose such confidential information to any other person or use it in any manner other than in discussion with Spell Casts liaisons and representatives;
- that all Content provided to you by the Company is the Company’s confidential and proprietary information and intellectual property, belong solely and exclusively to the Company, and may be used by you only as authorised by the Company;
- the reproduction, distribution and sale of the Content by anyone other than the Company is strictly prohibited; and
- that if you violate, or threaten to violate, any of your agreements contained in this paragraph we will be entitled to, among other things, injunctive relief to prohibit such violations.
Third Party Material and Websites. The Company may provide links to third-party materials and websites as a convenience to you and other Spell Casts clients. These third-party materials and websites are not part of the Spell Casts Service and they may be either withdrawn or terminated at any time without any liability on the part of the Company. You agree that you will be responsible for all payment and other obligations associated with your use of any and all third-party materials and websites. In addition, you agree that the Company is not responsible for examining and evaluating the content and accuracy of any third-party materials and websites, and the Company does not warrant and will not have any liability or responsibility for any third-party materials or websites or for any other materials, products, or services of third-parties. You further agree that you will not use any third-party materials and websites in a manner that would infringe or violate the rights of any other party and that the Company will not be liable for your improper use of third-party materials and websites.
Confidentiality. Spell Casts exercises reasonable diligence in maintaining the confidentiality of your sessions and we will not voluntarily, knowingly, intentionally, or willfully disclose your identity or the contents of your sessions with us to third parties. However, if Spell Casts genuinely believes disclosure is required to: (1) prevent imminent harm or risk of harm to yourself or to another, (2) meet any applicable law, regulation, legal process, or governmental request, or (3) protect or defend Spell Casts against claims or threats of claims, then Spell Casts reserves the right to do so to the extent reasonably necessary. Please keep in mind that no legally recognised privilege exists between a spell caster and client the way a privilege might exist between an attorney and client, doctor and patient, husband and wife, or priest and penitent.
Disclosure of Limitations. The services of Spell Casts of should never be used in place of professional counseling. Our services cannot offer legal, medical, business, or financial advice nor does any portion of your reading from Spell Casts purport to do so. You should not rely on any such entertainment-based service to make any decision that would affect your legal, financial, or medical condition. If your request involves the law, finance, or medicine, then you should seek the advice of a licensed or qualified legal, financial, or medical professional. Also, services by Spell Casts cannot replace qualified mental health care.
You expressly agree that your use or inability to use Spell Casts Services is at your sole risk. By purchasing access to Spell Casts’ Services, you accept, agree, and understand that you are fully responsible for your progress and results from your participation and that we offer no representations, warranties, or guarantees verbally or in writing regarding your ability to transform your life into something greater than its current status, or results of any kind. You alone are responsible for your actions and results in life and business which are dependent on personal factors including, but not necessarily limited to, knowledge, ability, dedication, commitment, mental stability, to name just a few. You also understand that any testimonials or endorsements by our customers or audience represented on our programs, websites, content, landing pages, sales pages, or offerings have not been scientifically evaluated by us and the results experienced by individuals may vary significantly. Any statements outlined on our websites, programs, Content, and offerings are simply our opinion and thus are not guarantees or promises of transformation and a better life.
Reservation of Right. From time to time, as would be ordinary for any business, Spell Casts may modify the Terms of Service and we reserve the right to do so at our discretion accordingly. The terms your service with us will be bound by will be the terms applicable at the time your service was rendered.
